We are a law firm that pursues title to abandoned vehicles.
At Title Counsel, your goals are our goals. As counsel, we exist to advise you of the most efficient, legal and economical process to achieve your desired result with the vehicle abandoned on your property. Most states have specific laws about vehicles that are abandoned on private property and at towing, storage, and repair facilities. If your state allows for us to pursue title to vehicles abandoned on your property, and you want title to that vehicle, that is what we will pursue. This gives you title, and the potential to retain cash from the sale of the vehicle.
If your goal is to have the vehicle removed and the chance at recovering monetarily, there are options for us to discuss and consider:
- First we consider whether your state statute addresses stored vehicles in default. If it doesn't, and there is a lienholder associated with the vehicle, it may make economic sense to allow the lienholder to remove the vehicle from your property.
- If there is no lienholder or we negotiate around the lienholder, we:
- Look to the language in your repair or lease contract and your state statute as to whether towing of the vehicle to a tow yard is permitted and what the lien and titling process is thereafter.
- Look to see if the abandoned vehicle has minimal economic value, we look at whether your state has a junk-vehicle statute, and depending on the value and statute, we can apply to retitle the abandoned vehicle as junk to be disposed of.
- Look at your lease language and state statutes to file a forcible entry and detainer (eviction) action for storage spaces. Eviction allows a court bailiff to take possession of the vehicle and have it towed off your lot. Although you don't receive title to the vehicle this way, it allows you to file a complaint for damages, file a default action if the complaint goes unanswered, and use the monies collected to pay off any lien and the amounts that you are owed from the storage customer.
